Many Adoptions Are Actually Non-Confrontational

Let us use an example. Say a stepfather wants to adopt his wife's child. Before that can happen, however, the biological father's parental rights must be terminated. Sometimes, the biological father will resist. Most times, though, the father will see that the adoption is actually in everyone's mutual best interests and consent to the adoption.

Once parental rights are terminated, the biological father no longer has an obligation to pay future child support.

If there were a conflict, however, the mother and stepfather would have to provide evidence that the biological father is an unfit parent. This could be because of drug use, abusive behavior, prolonged periods of absence in the child's life or failure to assume parental support obligations. If the court finds the biological father to be unfit, then his parental rights can be terminated, even against his will.

In most cases you will not need to appear in court - the circuit judge in your county will simply enter a final order of adoption of giving you all of the rights and responsibilities of the child's birth parent.
