In Florida, when police are summoned to a domestic disturbance and find evidence of domestic abuse, they may be duty-bound to make an arrest, even if the victim does not want to press charges. A family court judge will typically grant a temporary injunction (restraining order) barring you from returning home or contacting your spouse/partner or children.
Within 10 to 14 days, there will be a hearing on whether to make the injunction permanent. I step in to contest the basis for the assault charge, and to fight any continuation of the protective order. These injunctions often have no expiration date. This means you could be cut off from your children entirely or allowed only limited or supervised visitation.
