Legal Advocacy in the Early Stages of Divorce
As soon as a divorce action is filed, a process is set in motion that will govern your life for years to come. If you were served with papers — or even if you initiated the action — a proactive approach is critical. I can represent you in the issuance of temporary orders for child custody, child support and alimony, working to protect your short-term and long-term interests.
My name is Jeffrey Klein, a divorce and family law attorney based in Daytona Beach and practicing in Volusia County and Flagler County. Trust me when I say that temporary support and the initial arrangements for custody and visitation should not be ignored or assumed. Contact me today for the strong advocacy you need.
Temporary Orders for Support and Custody
A contested divorce in Florida commonly takes six months to a year or more. In the interim, the court will issue pendente lite orders for temporary child support, temporary custody and sometimes for temporary spousal support.
Most parents reach an agreement on where the child will live, and the court will formalize the arrangement. If there is evidence of drug abuse, domestic violence or other dangers to the child, a judge may award temporary sole custody to the other parent.
The court will step in to award interim child support, and may award temporary alimony and attorney's fees to spouses who are at an economic disadvantage.
The Early Bird Gets the Worm
Temporary support and custody orders will affect your short-term finances and the relationship with your child during the difficult divorce process. These orders also influence the court's decisions on permanent custody, ongoing financial support and division of property in the final settlement agreement.
I practice almost exclusively in family law, and I know the tendencies of local judges in these matters. As your lawyer, I take action to assert your wishes and make sure the court has accurate financial data as a basis for temporary orders.
