Florida Attorney for Unpaid Child Support
If the other parent has stopped making child support payments, the Law Office of Jeffrey A. Klein will pursue all legal remedies to force him or her to honor their financial obligations to you and your child.
I know that interruption in support creates hardships in your household. I work to locate the paying parent, if necessary, and obtain court intervention in a timely manner to get those checks coming in as soon as possible.
I am Jeffrey Klein and I practice in Central Florida. I handle child support enforcement and all family law matters in Volusia County and Flagler County, including enforcement actions against a payor spouse who has moved out of the area. Contact me today for a free initial consultation.
Child Support Enforcement
The first order of business is to file formal contempt of court charges with a motion to enforce support. Often the payee parent can request that the court enter a purge amount, establishing the threat of jail if the payor parent does not pay up. In addition, the payor parent's driver's license and professional license or licenses can be suspended for non-payment.
If the payor parent was employed when the initial child support order was entered, the court will likely have entered an income deduction order to have the employer garnish the payor parent's wages. The problem arises when the ex-spouse changes jobs, weaseling out of child support obligations until the court gets information on the new employer. Another problem is a spouse who is self-employed or paid in cash and underreports income. I will subpoena bank records and other data to prove true income.
Note: Do not withhold visitation as your method of child support enforcement. This can result in contempt of court proceedings against you. Let the Law Office of Jeffrey A. Klein advocate for you.
