Changing Court-Ordered Support

Child Support Modification Lawyer

I have represented both custodial and non-custodial parents in seeking or challenging a change in support.

The recipient parent can request an increase if the needs of the child have changed, such as for day care, school expenses or unreimbursed medical care. That parent can also ask for more child support if the ex-spouse's income has increased.

The paying parent has a heavier burden to prove to downgrade child support. In general, there must be a job loss and the payor must demonstrate a good faith effort to find another job. In addition, child support can be terminated when the child turns 18 or graduates from high school, though the burden is on the payor party to seek a modification.

Modification of Alimony

While child support is largely based on a formula and statutory guideline, alimony is need-based, and the amount and duration of alimony are often awarded at the discretion of the judge.

The payor ex-spouse may seek to reduce or terminate alimony, however, for various reasons:

  • Inability to pay (job loss)
  • The recipient ex-spouse has achieved financial independence
  • The recipient has remarried or entered a supportive relationship
  • The payor reaches retirement age
