Modifying Child Custody or Visitation

Changes to Parenting Arrangements

If one parent's circumstances have changed or the child's welfare is in jeopardy, either parent may petition the court for a modification of child custody. These proceedings can get adversarial very quickly. You want a lawyer who will take action to put you in a position of strength, but recognize and explore opportunities to resolve the dispute without the expense and animosity of a courtroom fight.

I am Jeffrey A. Klein, a divorce and family law attorney who has practiced in Daytona Beach since 2001. I represent parents who are initiating or challenging child custody modifications in Volusia County or Flagler County, including out-of-state clients whose child lives here.

Daytona Beach Custody Modification Lawyer

I have represented custodial and non-custodial parents, in various scenarios:

  • Petitions for sole custody because of an unfit parent (substance abuse, domestic violence, criminal activity, child abuse or neglect)
  • Parent relocation
  • Altering parenting plans to accommodate a new work schedule
  • Making the terms of "reasonable visitation" more concrete
  • Reversing primary custody, as with a teenager who wants to live with the other parent
  • Establishing Florida jurisdiction

The court will require a substantial change in circumstances or a compelling reason for modification of the child custody status quo. If the petition is contested, the process can be time-consuming and expensive. The court may require an in-depth investigation to determine the best interests of the child. My role is to gather documentation and supporting testimony, and advocate vigorously for your position.
