Parent Relocation

When One Parent Wants To Move Away With The Kids

Jeffrey A. Klein - Handling Florida Parental Relocation Issues

When parents are not living together, the circumstances of their lives can pull them in many different directions. But children have a right to see both of their parents. Moving far away can make that right difficult or impossible to exercise - and courts sometimes agree that it is in the best interests of the child to have relationships with both parents.

In Florida, you have to undergo a lengthy process to move with your children over 50 miles or across state lines. Relocation procedures are sensitive in nature and need to be handled by a lawyer who understands the boundaries set by the law.

I am Jeffrey A. Klein, a Daytona Beach, Florida, attorney who handles all varieties of family law issues. Unlike many other local lawyers, I am not a generalist. I have carefully reviewed and am familiar with recent changes to Florida law to set forth the procedures that parents must follow before relocating with their child or children.

To follow this parental relocation procedure, the relocating parent must:

  • File a "Notice of Intent to Relocate" and serve it to the other parent;
  • Include details like new address, phone number and reasons for the move
  • Include a proposal to accommodate the other parent's right to visitation and shared custody

The non-custodial parent then has 30 days to object or respond to the proposed plan or move. Eventually, the terms must be set forth in a written agreement. If the parents cannot agree, the matter will have to be settled in a court hearing.

Even if your case does not go to a hearing, you should hire an attorney to be sure that you do not settle for a relocation agreement that is not in your best interest.

If you would like to relocate or have been served a Notice of Intent to Relocate, call my office today for a free consultation. I can be reached by phone at 1-866-819-6032 or you can just contact me online.
